Ellsberg Defense Considering Calling on Fulbright to Testify; Leeway for Defendant Essential Testimony

defense attys in Pentagon papers case have reptdly still not decided whether to ask Sen Foreign Relations Com chmn Sen J W Fulbright to testify in behalf of D Ellsberg and A J Russo; decision depends on how much Ellsberg is allowed to go into his motivations for releasing papers to public when he resumes testifying; Ellsberg's contention is that he had higher duty while working for Rand Corp than protection of classified documents, and that he therefore copied papers so he could make them available to Fulbright and, through him, to Cong and the Amer people; defense has not reached final decision on whether to end its case with testimony from Prof R Falk, who would be called to testify on so-called 'negotiation' or 'diplomatic' volumes of papers; point of his testimony would apparently be that vols showed that US did not negotiate in good faith to end war; M Green, former Asst Sec of State for East Asia and now Amer Amb to Australia, is scheduled to testify as govt witness to effect that disclosure of 'negotiation' vols have in fact damaged natl defense, been prejudicial to US and been advantage to foreign nation
